3ds max > FBX > XNA > Animation Errors

i am working on a little XNA game. therefore i did some models and animations in 3dsMax8.
when i export this as an FBX file and use it inside XNA i get some unpredictable errors.

Example: i move the feet of my character - all works fine
as i animate the Bip01(the root bone) the animation will interpret some of the bones rotations totaly wrong.

this is reproducable. to get rid of this problem i actually set some new keyframe (by random)....and sometimes it works. but i cant tell why.
i need to have a reliable pipeline to generate animations.

Please can someone help me. I need some hints how to avoid this behaviour.
